Acceptance of Terms
These Website Terms (the "Terms") govern your access to and use of the website and online forms operated by C4RADS LLC ("C4RADS," "we," "us," or "our") (collectively, the "Site"). By accessing or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms.
Eligibility
The Site is intended for individuals and businesses located in the United States. You must be at least 18 years old to submit an application or inquiry. Driver applicants must hold a valid driver's license, maintain active auto insurance, have authority to use the vehicle for advertising, and provide accurate and current information. If you use the Site for an organization, you represent that you have authority to act for that organization.
Website Purpose and No Contract
The Site provides general information and collects inquiries from potential advertisers and driver applicants. Submitting a form, receiving a quote, or receiving an eligibility or approval notice does not by itself create a binding campaign, employment relationship, partnership, agency relationship, or guaranteed placement. Any campaign or driver participation will be governed by a separate written Campaign Order, driver agreement, or other applicable agreement, which controls if it conflicts with these Terms.
C4RADS Services
C4RADS LLC operates a vehicle-advertising service using professionally installed perforated rear-windshield graphics on participating vehicles. C4RADS does not offer full vehicle wraps. Services, campaign availability, driver availability, and timing depend on geography, campaign fit, creative approval, vehicle suitability, and operational capacity. We may modify, pause, or discontinue aspects of the Service, subject to applicable law and any separate written agreement.
Advertiser Responsibilities
Advertisers are responsible for the legality, accuracy, and substantiation of their advertising content and for obtaining all necessary permissions, licenses, and rights, including trademark, copyright, and publicity rights. Advertisers must ensure that offers, claims, disclaimers, and disclosures comply with applicable laws and regulations. C4RADS may decline, suspend, or remove creative that it reasonably considers unlawful, misleading, infringing, unsafe, regulated, offensive, or otherwise high risk.
Driver Applications and Participation
Driver applications are used to evaluate potential eligibility and campaign fit. Applicants must provide accurate and current information. Application, review, approval, or inclusion in the C4RADS network does not guarantee campaign placement, compensation, continued participation, vehicle safety, or compliance certification. Applying does not create an employment, agency, partnership, or spokesperson relationship with C4RADS or any advertiser. Driver status, responsibilities, verification requirements, and compensation are governed by a separate driver agreement and campaign-specific requirements.
Quotes, Payments, and Campaign Terms
Advertiser pricing is quote-only, and the Site does not provide public campaign checkout. Pricing, deposits, production costs, payment deadlines, cancellation terms, refunds, campaign dates, and other campaign details will be stated in a signed Campaign Order or similar agreement between C4RADS LLC and the advertiser. If these Terms conflict with a signed Campaign Order, the Campaign Order controls for that campaign.
Verification and Reporting
C4RADS may use reasonable verification measures, including installation and interior-visibility photographs, odometer documentation, periodic activity checks, campaign-status records, and, with appropriate notice or consent, approximate location or route information. C4RADS does not ordinarily direct a driver's exact routes or schedule. Reports may include active-vehicle counts, verified mileage, campaign days, generalized geography summaries, photographs, and clearly labeled estimated impressions. Reports may be limited by data availability, timing, technology, and methodology.
No Performance Guarantees
C4RADS does not guarantee any exact vehicle, driver, route, schedule, geographic coverage, impression count, lead, sale, conversion, revenue, or return on investment. Estimates, projections, photographs, mockups, examples, and campaign reports are informational only and are not promises of actual performance. Advertisers are responsible for determining whether the Service is suitable for their goals.
Intellectual Property
The Site and its text, graphics, logos, designs, and layouts are owned by or licensed to C4RADS LLC and are protected by intellectual-property laws. C4RADS grants you a limited, revocable, nonexclusive right to use the Site for lawful personal or internal business purposes. You retain ownership of materials you submit. By submitting information, artwork, photographs, feedback, or other materials, you grant C4RADS a nonexclusive, worldwide, royalty-free license to host, copy, review, modify, and use those materials as reasonably necessary to evaluate, prepare, operate, document, and report on requested services, subject to the Privacy Policy and any separate agreement. You may not otherwise copy, modify, distribute, or create derivative works from Site content without written permission, except as permitted by law.
Prohibited Uses
You may not use the Site or Service unlawfully or abusively; submit false, fraudulent, infringing, harmful, or misleading information or content; impersonate another person; collect information about others without authorization; interfere with the Site; introduce malicious code; attempt unauthorized access; circumvent security measures; or use the Site in a manner that infringes another person's rights. C4RADS may investigate suspected violations and take appropriate action, subject to applicable law.
Third-Party Services and Links
The Site may use or link to third-party websites, platforms, services, or tools, including Wix and other service providers. Third parties are independent of C4RADS and operate under their own terms and privacy practices. To the fullest extent permitted by law, C4RADS is not responsible for third-party availability, security, content, policies, or practices. Your use of third-party services is at your own risk.
Disclaimers
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE SITE AND SERVICE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY. C4RADS LLC DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND SECURITY. C4RADS DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, C4RADS LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES, ARISING FROM THE SITE OR SERVICE. C4RADS' TOTAL AGGREGATE LIABILITY ARISING FROM THE SITE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID DIRECTLY TO C4RADS FOR USE OF THE SITE DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED. Separate signed agreements may establish different limitations for paid campaigns or driver participation.
Indemnification
To the extent permitted by applicable law, you agree to defend, indemnify, and hold harmless C4RADS LLC and its owners, officers, employees, contractors, and service providers from claims, losses, liabilities, damages, judgments, costs, and reasonable attorneys' fees arising from your submitted materials or advertising content, your unlawful or unauthorized use of the Site or Service, your infringement of another person's rights, or your violation of these Terms or applicable law.
Suspension or Termination
C4RADS may suspend or terminate access to the Site or Service, reject an application, remove content, or pause or adjust activity if it reasonably believes a user has violated these Terms, submitted unlawful or high-risk content, created security or legal risk, or harmed C4RADS, advertisers, drivers, or others. Campaign and driver actions remain subject to applicable law and any separate written agreement.
Governing Law and Venue
These Terms and disputes arising from the Site or Service are governed by the laws of the State of Utah, without regard to conflict-of-laws principles. Except where applicable law requires otherwise or a separate signed agreement provides otherwise, the state and federal courts located in Utah County, Utah will have exclusive jurisdiction, and each party consents to personal jurisdiction and venue in those courts.
Changes to These Terms
C4RADS may update these Terms to reflect changes in the Service, business practices, or applicable law. We will update the Effective Date and provide any additional notice required by law. Changes apply prospectively when posted or on a later stated date. Continued use of the Site after the effective date constitutes acceptance of the updated Terms.
Privacy
The C4RADS Privacy Policy is incorporated into these Terms by reference and explains how information is collected, used, retained, and shared. If these Terms conflict with the Privacy Policy concerning personal information, the Privacy Policy controls.
Contact
If any provision of these Terms is found unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. You may not assign these Terms without C4RADS' written consent; C4RADS may assign them in connection with a reorganization, merger, financing, sale, or transfer of the Service. Provisions that by their nature should survive termination will survive. These Terms, together with the Privacy Policy and any applicable signed agreement, constitute the agreement governing your use of the Site. Electronic notices and records may satisfy written-communication requirements. Questions may be submitted through the FAQ / Contact form at C4RADS.com. Do not include Social Security numbers, complete payment-card numbers, or other highly confidential identifiers.
